TERMS OF SERVICE - MY EA - EXECUTIVE ASSISTANT

(ALSO TRADING AS LINDA GLENTHØJ)

Unless otherwise agreed in writing, these terms and conditions apply when entering into an agreement on purchasing services and products from My EA - Executive assistance.

CONFIDENTIALITY & RIGHTS

  • My EA - Executive Assistance and associates shall keep any work undertaken confidential and not use it for personal gain or promotion without the written consent of the Client.

  • The business affairs of the Client shall not be discussed or disclosed to any third parties without prior written permission from the Client.

  • The Client will be the legal owner and will hold the intellectual copyright of all work undertaken by My EA - Executive Assistance or her associates.

  • All images supplied by the client remain their responsibility, with regard to obtaining rights for use. All images supplied by My EA - Executive Assistance or her associates will be sourced with permission.

 

PAYMENTS & BILLING

  • Initial twenty-minute consultation by Zoom, another preferred platform or telephone is complimentary.

  • All prices are inclusive of VAT unless otherwise stated. VAT is 25% of the purchase price and any fees for payment with your payment card are not subject to VAT. In case of payment outside of DK, reverse charge VAT applies.

  • My EA accepts VISA-Dankort, MasterCard, Pay, MobilePay, and Bank transfer payments.

  • Monthly: Up to 5 unused hours can be transferred to the following month.

  • Packages: Hours must be used within a three-month period.

  • Final proofreading and checking of all work supplied is the responsibility of the client.

  • The Client understands My EA - Executive Assistance or her associate’s estimated time and cost for completing the Work is an informal calculation and that any adjustments to the amount of work, schedule and/or the number of hours and fees are subject to review and renegotiation with the Client when necessary.

  • Any errors must be reported within two (2) days of receipt of completed work. Errors generated by My EA - Executive Assistance or her associates will be rectified free of charge, but amendments or alterations requested by the client thereafter will be charged at the standard hourly rate.

  • If, however, on receipt of the item to be worked on or at an early stage, it becomes apparent that significantly more work is required than had been anticipated in the preliminary discussion/brief, My EA - Executive Assistance may renegotiate the fee and/or the deadline.

  • Similarly, if, during the term of My EA - Executive Assistance work, additional tasks are requested by the Client, My EA - Executive Assistance may renegotiate the fee and/or the deadline.

  • Should ongoing project work be suspended or delayed through any default of the client, My EA - Executive Assistance shall be entitled to immediate payment for work already carried out and expenses incurred.

  • An agreement, in writing or by email, of a set number of hours a week or month may not be carried over to subsequent periods by the client, without prior written agreement from both parties.

  • If the project is based on an hourly rate, then a minimum invoice amount is for one hour and the hourly rate is then billed in increments of 30 minutes, with time rounded up to the nearest half of an hour.

  • Clients will be invoiced either after an individual assignment is completed or on an ongoing monthly basis.

  • First-time clients will initially be invoiced in advance of work commencing. All subsequent work will be invoiced will be at the end of every calendar month.

  • Invoices are to be settled within seven (7) days of delivery unless otherwise agreed upon. The final invoice shall include billable time, reimbursable expenses, and any other fees related to the Work.

  • Unpaid bills will incur interest, as per government guidelines. It is at My EA - Executive Assistance discretion whether work continues after a bill remains unpaid beyond my 7-day payment period.

  • Billable time includes meetings and calls outside of contracted hours and includes the writing and/or reading of correspondence sent by mail or email.

  • A time report will be provided with the invoice unless the client requests otherwise.

  • All postage, printing, and other stationery expenses bought on behalf of the Client’s business will be added to the invoice for reimbursement.

  • Once an invoice becomes overdue, no further work will be undertaken.

  • Under the terms of the Data Protection Act 1998 / GDPR, the Client and the My EA - Executive Assistance or her associates may keep such information (e.g., contact details) as is necessary on record. Either may view the other’s records to ensure that they are relevant, correct and up to date.

  • Either the Client, My EA - Executive Assistance or her associates have the right to terminate a contract for services if there is a serious breach of its terms.

Withdrawal from Digital Products

When purchasing packages and services, the right of withdrawal lapses. According to the Sale of Goods Act, there is unfortunately no right of withdrawal on digital products that are put into use. Put into use means that if the digital product has been downloaded, it has been put into use and cannot be canceled.

However, please contact me if the product does not meet your expectations.

RIGHTS AND COPYRIGHT

All rights to digital products belong to My EA - executive assistance.

Upon purchase, a license is granted to use the purchased product as indicated under the product in question. Your digital product is personal, and it is not allowed to sell, forwarded, lend, given away or otherwise distribute the purchased product, either privately or commercially. This applies both to the content of our online products and downloaded products.

Worksheets, forms, reports and other documents and materials that we provide to you in connection with the course and other online products are owned by or licensed to us and are protected by Danish and international law.

We own the copyright in all creative and literary works incorporated in our materials. Your use of our materials does not grant you a license or operate as a right of use to copy or use the material in your business or share with others, whether registered or unregistered, without our express written permission. Alteration and modification are also not permitted.

  • to conduct my business affairs based on sound, ethical principles and will communicate fairly and honestly with your clients, associates, employees, and suppliers.

  • to respect the confidentiality of your personal and business practices and recognize your ownership of any intellectual copyright pertaining to your business activities.

  • to strive to maintain my high professional standards by staying abreast of advances within my industry and to strive for excellence through professional improvement.

  • to keep all acquired personal data safe and secure and ensure it is only used for its intended purpose, in accordance with GDPR and all regulations set by the ICO.

 

AN EXTRA BIT ON GDPR

While I take every step known to me and in accordance with guidance on the ICO website to keep data safe and secure I will never be fully immune to hacks, no one is.

COOKIE AND PRIVACY POLICY

When you visit our website, information about you is collected, which is used to personalize and improve our content and to target relevant advertisements to you on the internet. If you do not want the information to be collected, you should delete your cookies (see instructions) and refrain from further use of the website.

The website uses "cookies", which is text files stored on your computer, mobile phone or similar to recognize it, remember settings, perform statistics and target ads. Cookies cannot contain malicious code such as viruses.

PERSONAL DATA

Personal data is any kind of information that can be attributed to you to some extent. When you use our website, we collect and process a range of such information.

We typically collect and process the following types of information: A unique ID and technical information about your computer, tablet or mobile phone, your IP number, geographical location and which pages you click on (interests). To the extent that you explicitly consent to this and enter the information yourself, we also process Name, telephone number, e-mail, address and payment information. This will typically be in connection with the creation of a login or when making a purchase.

SECURITY

We have taken technical and organizational measures to prevent your data from being accidentally or illegally deleted, published, lost, impaired or disclosed to unauthorized persons, misused or otherwise processed in violation of the law.

 

PURPOSE

The information is used to identify you as a user and show you the ads that are most likely to be relevant to you, to register your purchases and payments, and to provide the services you have requested, such as sending a newsletter. In addition, we use the information to optimize our services and content.

 

PERIOD OF STORAGE

The data is stored for the period permitted by law and we delete it when it is no longer necessary. The period depends on the nature of the data and the reason for storage. It is therefore not possible to give a general timeframe for when information is deleted.

 

DISCLOSURE OF INFORMATION

Disclosure of personal data such as name and e-mail will only occur if you consent to it. We only use data processors in the EU or in countries that can provide adequate protection for your data.

 

ACCESS AND COMPLAINTS

You have the right to know what personal data we process about you. You can also object to the use of your data at any time. You can also withdraw your consent to the processing of your data. NOTICE PERIOD

The notice period is ideally one month and in writing, but I appreciate this isn’t always possible.

 

WORDPRESS

I can and do offer WordPress/SquareSpace support to clients, but it is the client’s responsibility to ensure regular backups are made of their website.

 

BOOKKEEPING

A bookkeeper does not replace the need for an accountant. It remains the Client’s responsibility to ensure their taxes are in order and that they pay all fees due to authorities,

 

MY WORKING HOURS

Family and relaxation time is from 17:00 Monday to Friday and all weekend; any communication outside of these hours will normally be dealt with on the next working day unless agreed in advance.

 

COMMUNICATION

I prefer to receive all communication and instructions via email only unless otherwise agreed upon.

 

TURNAROUND

My retained clients get priority. If you know you’ll be needing a set amount of hours every month, a specific task completed every month, or there’s a possibility any of your tasks will need my attention within two working days then a retainer package is your best option. You can retain my time, at my usual hourly rate, anything from an hour a month.
